The CCG contacted you on 12th December 2018 to let you know that the CCG did not hold the majority of the information you had requested. At that time, we explained to you at that we would undertake further discussions with colleagues to explore what relevant information the CCG might be able to provide. We have now concluded those discussions and are able to release our response which provides the limited information that the CCG holds accompanied by advice and guidance for you concerning the other requested information.
Please note that the information the CCG does hold in relation to question 2a (inpatient neurological rehabilitation settings) is exempt under section 40 (2) (Personal Information) of the Freedom of Information Act 2000. This is because the numbers of patients in question is very low and disclosure could lead to identification of individuals’ identities. The CCG is of the view that this would not be “fair” to the individuals concerned and would therefore contravene the data protection principles. As such the CCG is issuing a refusal notice under section 40 (2) concerning this information. This exemption is an absolute exemption and therefore is not subject to a public interest test.
